These Terms of Service ("Terms") govern your access to and use of the Predictwise website, application, dashboard, tools, signals, data, content and related services (collectively, the "Service") operated by Predictwise ("Predictwise", "we", "us" or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Description of the Service

Predictwise is a technology platform designed to help users discover, analyze and act upon opportunities in prediction markets.

The Service may provide market data, signals, alerts, rankings, wallet activity, market statistics, probability estimates, opportunity scores, historical information and other analytical or informational content.

Predictwise does not operate or control the underlying prediction markets. Transactions, positions, settlement and other activities may be executed through third-party platforms and services.

Predictwise is a technology and information service and is not a bank, broker, investment adviser, financial adviser, exchange, custodian or asset manager.

2. No Financial or Investment Advice

All information, signals, scores, predictions, estimates and other content provided through the Service are for informational and educational purposes only.

Nothing provided by Predictwise constitutes:

  • investment advice;
  • financial advice;
  • trading advice;
  • legal or tax advice;
  • a recommendation to buy, sell or hold any position;
  • a guarantee regarding the outcome of any prediction market.

You are solely responsible for evaluating any information provided by the Service and for deciding whether to take any action.

Past performance, historical results, wallet activity, signal accuracy or any other historical information does not guarantee future results.

3. Prediction Market Risk

Prediction markets involve substantial risk and may result in the loss of some or all of the funds you commit.

You acknowledge that:

  • prediction market outcomes are uncertain;
  • market prices may change rapidly;
  • liquidity may be limited;
  • positions may become difficult or impossible to exit;
  • third-party platforms may experience outages, delays or technical failures;
  • markets may be suspended, cancelled or resolved in a manner you did not anticipate;
  • blockchain transactions may be irreversible;
  • network fees and other transaction costs may apply;
  • regulatory treatment of prediction markets may differ between jurisdictions and may change over time.

You should only use funds that you can afford to lose.

4. Signals and Automated Analysis

Predictwise may generate or display signals based on market activity, historical data, wallet activity, liquidity, price movements, statistical models, algorithms, artificial intelligence or other sources.

Signals are inherently probabilistic and may be inaccurate, incomplete, delayed or based on imperfect information.

A signal labelled as "High Confidence", "Pre-Move", "Smart Money", "Whale Follow" or using any similar terminology does not mean that Predictwise guarantees the outcome of a trade or prediction market.

Any expected move, probability, score, historical ROI or similar metric displayed by the Service is an estimate and should not be interpreted as a guaranteed result.

5. Third-Party Platforms

The Service may connect to, redirect you to, or otherwise interact with third-party platforms, including prediction market platforms, wallet providers, blockchain networks, data providers and other services.

Your use of any third-party service is governed by that third party's own terms, privacy policies and other applicable rules.

Predictwise does not control and is not responsible for:

  • third-party platform availability;
  • third-party fees;
  • market resolution;
  • transaction execution;
  • liquidity;
  • settlement;
  • wallet functionality;
  • blockchain network performance;
  • smart contracts;
  • third-party security;
  • changes to third-party APIs or services.

If you execute a transaction on a third-party platform, the transaction is between you and the relevant third party.

6. Non-Custodial Use

Where the Service supports connection to a wallet or wallet provider, Predictwise does not take custody of your funds unless expressly stated otherwise.

You remain responsible for your wallet, private keys, recovery credentials, authentication methods and transactions.

Predictwise does not guarantee the recovery of lost credentials or assets.

Blockchain transactions may be irreversible. Predictwise cannot reverse, cancel or recover a transaction once it has been submitted to a blockchain or executed by a third-party platform.

7. Fees

Predictwise may charge fees for access to certain features or services.
Where applicable, fees will be disclosed to you before they become payable.

Profit Share — No Profit, No Fee.

Where applicable, Predictwise may charge a Profit Share equal to 15% of your net realized profits generated through the Services. If you have no net realized profit, no Profit Share will be charged. Profit Share is calculated based on realized gains after applicable losses and may be subject to a high-water mark or other calculation methodology disclosed by Predictwise. The applicable Profit Share, calculation method and amount payable will be disclosed to you before the fee becomes payable. 

Third-party fees, blockchain network fees, market fees and other costs charged by external platforms are separate from Predictwise fees unless expressly stated otherwise.

Predictwise reserves the right to change its fees prospectively. Any material change to applicable fees will be communicated before the new fees apply to you.


8. User Accounts

Certain features may require you to create an account or connect an authentication method or wallet.

You agree to provide accurate information and to keep your account credentials secure.

You are responsible for all activity conducted through your account or connected wallet, except to the extent caused by Predictwise's proven unauthorized access resulting from our breach of these Terms.

You must not:

  • use another person's account without authorization;
  • attempt to gain unauthorized access to the Service;
  • interfere with the operation of the Service;
  • circumvent security or access controls;
  • use the Service for unlawful purposes;
  • use automated systems to abuse or overload the Service;
  • manipulate or interfere with signals, rankings or market data;
  • reverse engineer the Service except where expressly permitted by applicable law.

9. Eligibility and Restricted Use

You may use the Service only if you are legally permitted to do so in your jurisdiction.

You are responsible for determining whether your use of prediction markets and the Service is lawful in your location.

Predictwise may restrict, suspend or terminate access to the Service for users located in jurisdictions where the Service or underlying activities are prohibited or restricted.

Predictwise may also impose additional eligibility requirements for particular features.

10. Prohibited Activities

You may not use the Service to:

  1. violate any applicable law or regulation;
  2. commit fraud or facilitate fraudulent activity;
  3. manipulate markets or market data;
  4. interfere with third-party platforms;
  5. introduce malware or other harmful code;
  6. attempt to gain unauthorized access to systems or accounts;
  7. scrape, copy or commercially exploit the Service without permission;
  8. circumvent fees, usage restrictions or technical controls;
  9. use the Service in connection with unlawful gambling, financial activity or other prohibited activity where applicable.

11. Intellectual Property

The Service, including its software, design, interface, branding, trademarks, text, graphics, databases, algorithms, models and other content, is owned by or licensed to Predictwise and is protected by applicable intellectual property laws.

Subject to these Terms, Predictwise grants you a limited, non-exclusive, non-transferable and revocable right to access and use the Service for its intended purpose.

You may not reproduce, modify, distribute, sell, sublicense or create derivative works from the Service or its proprietary content without our prior written permission.

12. Data and Market Information

Market data and other information displayed through the Service may originate from third-party sources.

Although Predictwise seeks to provide useful and timely information, we do not guarantee that any information is accurate, complete, current or error-free.

Market data may be delayed, interrupted, unavailable or incorrectly reported.

You should independently verify material information before making any decision.

13. Availability

We do not guarantee that the Service will always be available, uninterrupted, secure or error-free.

The Service may be modified, suspended or discontinued at any time, including for maintenance, upgrades, security reasons or circumstances beyond our reasonable control.

Predictwise is not responsible for losses resulting from outages, delays, API failures, network failures, blockchain congestion or other technical issues outside our reasonable control.

14. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

PREDICTWISE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY AND AVAILABILITY.

PREDICTWISE DOES NOT WARRANT THAT:

  • THE SERVICE WILL MEET YOUR REQUIREMENTS;
  • SIGNALS OR PREDICTIONS WILL BE ACCURATE;
  • YOU WILL MAKE A PROFIT;
  • ANY PARTICULAR MARKET OUTCOME WILL OCCUR;
  • THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE;
  • THIRD-PARTY SERVICES WILL REMAIN AVAILABLE OR FUNCTION AS EXPECTED.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREDICTWISE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, DIGITAL ASSETS OR OTHER VALUE ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

THIS INCLUDES LOSSES ARISING FROM:

  • TRADING OR PREDICTION MARKET DECISIONS;
  • SIGNALS OR ANALYTICAL CONTENT;
  • MARKET MOVEMENTS;
  • THIRD-PARTY PLATFORM FAILURES;
  • WALLET OR BLOCKCHAIN ISSUES;
  • TRANSACTION ERRORS;
  • HACKS OR SECURITY INCIDENTS;
  • MARKET RESOLUTION;
  • NETWORK FEES OR OTHER TRANSACTION COSTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF PREDICTWISE ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PREDICTWISE DURING THE SIX MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) USD 100.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

16. Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold harmless Predictwise and its affiliates, officers, directors, employees, contractors and service providers from claims, liabilities, damages, losses and expenses arising out of or related to:

  • your use of the Service;
  • your violation of these Terms;
  • your violation of applicable law;
  • your transactions on third-party platforms;
  • your infringement of any third-party rights.

17. Suspension and Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe that:

  • you have violated these Terms;
  • your use creates legal, regulatory, security or operational risk;
  • your account is involved in fraudulent or abusive activity;
  • suspension is required by law or a third-party provider.

You may stop using the Service at any time.

Termination does not affect provisions that by their nature should survive termination, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification and governing law.

Geographic Restrictions:

Access to certain Predictwise features may be restricted based on your location and applicable third-party platform requirements. Users must not use VPNs, proxies or other methods to circumvent geographic restrictions.

Where Predictwise provides access to or functionality related to Polymarket, the following jurisdictions are currently restricted: Australia, Belgium, Belarus, Brazil, Burundi, Central African Republic, Democratic Republic of the Congo, Cuba, Germany, Ethiopia, France, United Kingdom, Ireland, Iran, Iraq, Italy, Japan, North Korea, Lebanon, Libya, Myanmar, Malta, Nicaragua, Netherlands, New Zealand, Poland, Russia, Singapore, Slovakia, Somalia, South Sudan, Sudan, Syria, Taiwan, Thailand, United States, Venezuela, Yemen and Zimbabwe.

Additional regional restrictions may apply, including certain provinces of Canada and territories of Ukraine. This list may change from time to time in accordance with Polymarket's applicable geographic restrictions.

19. Changes to the Service

Predictwise may modify, add or remove features of the Service at any time.

We may also update these Terms from time to time.

When material changes are made, we will provide reasonable notice through the Service or by other appropriate means.

Your continued use of the Service after the updated Terms become effective constitutes acceptance of the revised Terms.
